Inzy’s Commission Terms of Service

What to Know Before You Request a Commission

  • When you request a commission, you understand and agree to my Terms of Service.

  • You do not need to make an account on Artistree.

  • You must be able to pay via Artistree. Typically, you can pay with credit, debit, Apple Pay, Google Pay, or Cash App Pay. While some artists on Artistree are able to accept payments with Paypal, I currently cannot.

  • You must be 18 years of age or older to request a NSFW commission.

  • I may decline your commission request for any reason.

  • Prices listed on my commission sheet are estimates. The final price will be set upon the accepting of your commission request and you will see it on the invoice sent to you by Artistree.

  • I’m happy to answer any questions you may have! Feel free to send me a message.

Commission Requests

  • Fill out the request form on Artistree. If your request was discussed previously in DMs, please write out your request in detail. I will ask you to rewrite your request if it does not contain the expected details (do not put, "discussed in DMs" in the request form). I can fill out the request form for you, but I will require your email.

  • You can request something that is not listed on the commission sheet.

  • You are required to provide a reference image for characters featured in the commission. If the characters in the request are owned by me or are easily searchable online, you are not required to provide a reference image for those characters. You are also not required to provide references for generic or non-descript characters (characters for which you don’t care how they look).

  • You may provide as many additional reference images as you wish.

  • Wait for the commission request to be accepted by me. If I accept, Artistree will create an invoice and send it to you. The invoice includes the price and the Terms of Service. This is not the same as my public Terms of Service. It will contain details that a generic Terms of Service cannot include (for example, the amount of revisions you receive). To not confuse these, I will refer to my public Terms of Service as the Terms of Service and Terms of Service on Artistree as the commission details. (This is a result of how Artistree handles the Terms of Service. I apologize for any confusion.)

  • You can negotiate the price, especially if your commission has a lot of add-ons, but please be reasonable.

  • After I accept the commission, you will be sent an invoice. Review the invoice and commission details. If everything is all good, complete the payment process. Do not complete the payment process if you believe there is an issue with the invoice or commission details.

Commission Process, Revisions, and Completion

  • I will begin working on your commission only after you pay for the commission. This might not be immediate as you will be placed into the queue. I try to keep the queue length in mind when I send you the estimated time of completion.

  • For commissions that move past the sketch phase, I will send you WIPs (works in progress) periodically. You can either approve the WIP or ask for a revision. Typically, WIPs will be of lower resolution than what is outlined in the request.

  • When the commission is completed, I will send you a final version. As with WIPs, you can either approve the final version or ask for a revision. Accepting the final version is considered the completion of the commission.

  • Generally, you are allowed one major revision in the sketch phase for non-sketch commissions. You are allowed at least one, but up to infinite minor revisions as you want at any stage (within reason).

  • If you choose to exceed your revision limit (and confirm that you wish to do so), I may send you an additional invoice that must be paid before I continue with the work. You will be informed prior to me sending the invoice. You are not eligible for refunds for payments of this type. You may choose to cancel your revision request and work will continue as normal.

  • I will usually send 2 images, typically PNG files, as the final work. One of which contains my signature and a similar one of which does not.

Payment

  • As of the time of writing, Artistree charges a 6.5% fee, plus an additional $2.60 USD if the payment is less than $100.00 USD. These fees are not reflected in the estimates.

  • Typically, 100% of the payment occurs after the commission request has been accepted and before I begin working on the commission.

  • While I prefer this method for all commissions, I understand that you may want to pay in a different way! We can discuss this as needed to come to an agreement. Please keep in mind that if you make multiple payments less than $100.00 USD, Artistree's fees will apply for all of those payments.

  • I currently do not accept payments outside of Artistree.

  • Artistree allows tips to be sent after you accept the final version of the commission. As of the time of writing, Artistree does not apply its fees to tips. Do not use tips to pay for the commission.

Refunds and Cancellations

  • You may cancel an accepted commission if the commission has not yet had payments made towards it.

  • I may also cancel an accepted commission if the commission has not yet had payments made towards it.

  • I reserve the right to fully refund a commission for any reason.

  • You reserve the right to a full refund of a commission at request if I did not begin work on the commission.

  • If you want a refund for a commission I have already begun, this will be a partial refund. We will discuss this. I am not obligated to issue a partial refund. If we do not reach an agreement, work may continue as normal.

  • If you believe I am being unfair or unreasonable, you may ask Artistree for a refund. Artistree will review your case. Your refund request may be denied, in which case work may continue as normal.

  • You are not eligible for refunds for payments for extra revisions.

  • If you are rude or inappropriate, your commission will be cancelled, and the amount you are refunded will depend on the amount of work that was completed.

  • Work towards the commission may pause when a refund is requested. Work towards the commission may end and your commission will be cancelled when a refund is issued or when a chargeback is requested or issued.

Ownership Rights and Distributions

  • I own full rights to the content I produce. This means that I can use commissions I draw to promote myself, for example.

  • The ownership rights of existing characters and other intellectual property that are featured in the content you have purchased from me are not inherently modified or transferred due to featuring in my content or the purchase of my content. Basically, if I draw my character in the commission, I will still own the character. If I draw your character in the commission, you will still own the character.

  • If you buy a character from me or purchase a design commission, you will own the rights to those characters or character designs. Ownership rights will be mentioned in the commission details.

  • You may use, modify, reproduce, and redistribute the whole or partial content you have purchased from me for personal use.

  • You may NOT use, modify, reproduce, or redistribute the whole or partial content you have purchased from me for non-commercial or commercial use, except where otherwise stated. Permissions may be granted at request (send me a message!). You may request to purchase a commercial license for any content you purchase from me at the time of or after the time of purchase.

  • Remember that it doesn’t hurt to ask! I might allow you to use the commission in commercial content anyway as long as it’s not the main subject. Also ask for permissions if your use case is non-personal but also non-commercial (for example, using it as part of a public research study).

  • You may upload and host content you have purchased from me to any website, except for booru or booru-like imageboard websites and where otherwise stated (you can review what a booru website is with this wikipedia article. Do note that gallery sites are not inherently boorus, so you are free to post the art to FurAffinity, DeviantArt, and similar sites).

  • The content I produce, in part or in whole, may not be used to train neural networks or generative artificial intelligence, without exception.

  • You do not have to credit me to post or share content you have purchased from me. However, you may not pass off my work as your own. Of course, credit is very much appreciated.
